BYE-LAWS AND REGULATIONS (REVISED 2011)
For the purpose of these Bye-Laws and Regulations a Member is defined as a Playing
Member
1. Playing Members, other than Junior Members, must hold at least 5 Shares in the
Company. Members must either, be proposed and seconded by Members or be sponsored
by another recognized golf club. The details shall be exhibited on the Notice Board
for not less than 7 days before submission to the Directors at their next meeting. The
Directors may in their absolute discretion approve or reject the proposal and shall be under
no obligation to give reasons for any rejection nor to require any person, including the
applicant, to state a case supporting or opposing the proposal.
2. (a) The Annual Subscriptions and Entrance Fees shall be decided each year by the
Directors. Details will be posted on the Notice Board by the 1st January each year.
(b) The Annual Subscription shall be due on the 1st January in each year. If any
subscription be not paid within a reasonable period of time from this date, as determined
by the Directors, a notice shall be sent calling on the defaulting Member to pay and, if not
paid within the further period of time specified in the notice, that Member shall cease to be
a Member of the Club, unless the Directors, for good cause shown, see fit to determine
otherwise.
(c) By concession, the Directors may allow the Annual Subscription and/or entrance
Fee to be paid in instalments. Members electing to pay the Annual Subscription and/or
Entrance Fee by instalments, remain liable for any unpaid instalments in the event of them
tendering their resignation or otherwise ceasing to be a member. If any instalment is not
paid within a reasonable time from its due date, as determined by the Directors, all future
instalments become due and payable and the Directors may invoke the procedures set out
in sub-clause (b) above.
3. Non-Golfers may be elected as “House Members” on payment of an Annual Subscription
as determined from time to time by the Directors. A non playing spouse or partner of a fee
paying, Playing Member is eligible for free house membership.
4. (a) Playing Members may introduce no more than 12 Guests per year at a reduced Green
Fee and can only introduce up to 3 Guests at any one time.
5. Members shall cease to be Members:
(a) If they resign in writing prior to the expiry of the current subscription year.
(b) If their Subscriptions are unpaid in accordance with Clause 2 or if any other monies
properly due to the Club are unpaid within a reasonable period of time from the due date
as determined by the Directors.
Members who resign shall not be entitled to a subscription refund
6. The Directors, acting bona fide in the interests of the Club, shall have the following
powers:-
(a) To suspend the Membership of any Member for any misconduct, breach or breaches
of the Bye-laws and Regulations, and any other Order of the Board of Directors, or other
good and sufficient cause. Before a Member is suspended, their conduct shall be
investigated by the Directors and they shall be given full opportunity to defend themselves
and to justify or explain their conduct. Upon being suspended a Member shall cease to be
entitled to enjoy any of the Club’s facilities for such period as the Directors shall
determine.
(b) To expel from the Club any Member whose conduct is such as it shall, in the opinion
of the Directors, be injurious to the interests of the Club or of Members or be such as to
render themselves unfit for Membership of the Club. Before a Member is expelled their
conduct shall be investigated by the Directors and they shall be given full opportunity to
defend themselves and to justify or explain their conduct. If a majority of the Directors
present when the matter is investigated are of the opinion that the Member has been guilty
of such conduct and that the Member has failed to justify or explain it satisfactorily, the
Directors shall call upon the Member to resign in accordance with Clause 5(a) and if they
do not resign within a period of seven days shall forthwith expel them by notice in writing.
(c) An expelled Member shall forfeit all the privileges of Membership from the date
specified in the Notice of Expulsion but shall not be entitled to any refund of his/her
Annual Subscription for the residue of the year during which they are expelled.
7. Juniors under the age of 18 shall not be allowed to play on the Course at such times as are
determined by the Directors, as detailed in the Terms and Conditions (Course), nor shall
they be served with alcoholic drinks.
8. A visitor shall not be entitled to play until his or her name shall have been entered in the
Visitor’s Book and the Green Fee, as determined from time to time by the Directors shall
have been paid.
9. Correct dress as advised by the Directors shall be worn in the Club House and on the
Course at all times as detailed in the Terms and Conditions (Course).
10.No dogs shall be allowed in the Club House or on the Course.
11.The Club House shall be open for such hours as are determined by the Directors. The
hours during which alcoholic drinks may be sold shall be such as are permitted by law and
fixed by the Directors and approved by the necessary Licensing Authority. A statement of
these hours shall be fixed in a prominent position in the Club House. No Member, Visitor
or Club Employee shall be permitted to bring alcoholic drinks into the Club House without
prior authorisation by the Directors.
12.Subject to any restrictions which may from time to time be imposed by the Directors, the
following persons shall be entitled to admission to the Club Premises and, subject to the
provisions of Rule 7 to the Bye-Laws and Regulations, to purchase alcoholic drinks for
their own consumption on these premises, viz,
(a) Members and their Guests
(b) Visitors
(c) Club Employees.
13.The right is reserved to the Directors to close the Course on any day or days when they
shall deem it expedient to do so in the interests of the Club.
14.The Directors have determined that with the use of Membership tags it is each Member’s
duty to approach players not displaying such tags to ascertain either proof of Membership
or payment of the appropriate Green Fee.
15.It is a condition of play on the Course that any golfer accepts that golf balls lost or
abandoned within the boundaries of the Course become the property of the Club to
the exclusion of the previous owners, even if previous ownership can be proved. The
Directors will take such action as they deem appropriate against any person removing golf
balls from within the boundaries of the Course but by concession, golfers and their caddies
may retain any golf balls found on the course during normal play.
16.Members and Visitors causing damage to property adjacent to the Golf Course during
play or practice, have an obligation to report the incident to the Office or Professional and
accept liability for the damage caused.
17.ALL Members and Visitors are expected to hold adequate personal golf insurance,
covering liability for any damage to 3rd party property, injury, loss or damage to persons or
their property whilst on the Golf Course, in the Club House or other areas of the Grounds.
18.These Bye-Laws and Regulations, may be altered or varied from time to time by the
Directors in accordance with Article 32 of the Articles of Association of the Company,
and such alterations or variation shall take effect on being posted in the Clubhouse.
